Who needs a Will

The short answer – everyone. Regardless of age, regardless of wealth, everyone should create a Will so that on death their estate can be distributed as per their wishes.

Why have a Will

Without a Will to indicate your wishes the court steps in and distributes your property. If you have no apparent heirs and die without a Will it is even possible that the state may claim your estate.

Unmarried partners and partners who have not registered a civil partnership cannot inherit from each other unless there is a Will.

The use of a properly drafted trust in the Will can also help protect the value of your home from care home fees.

How Maidstone Wills can help

Well, firstly we discuss with you the sort of questions you need to consider when making a Will; the sort of “what to you want to happen if…………..? scenario. We then visit you at a convenient time to take your instructions which normally takes about 45 minutes.

We will then prepare a draft of the Will and talk you through it to make sure it meets your needs. Once you approve the Will it is passed to an in-house solicitor who checks it for drafting and legal validity before it is bound and issued to you together with instructions for signing.

What about a do-it-yourself Will

Will drafting is a very technical skill and the language used has purpose. Even punctuation can alter legal interpretation. With a DIY Will it can sometimes be difficult to know what the Will maker actually intended and the legal costs of applying for rectification or interpretation of a poorly drafted Will can be very substantial – even if all the beneficiaries and interested parties agree.

Take the time to make Will now...

...and get on with your life, safe in the knowledge that your loved ones will be provided for in line with your stated wishes.
